When the transfer pricing rules were introduced in 2001, this issue was completely unknown. The high need for documentation and the heavy penalties imposed by the regulations caused concern for any taxpayer who made significant international transactions, as there was no basis for how to enforce the law. With the rapid development of the country`s indirect taxes on trade, consumption, etc., the main types of taxes were at the beginning of the 20th century. Since then, the trend towards income taxation has become increasingly important. The introduction of transfer pricing rules took place in India in 2001, which provided for the price of weapons length in international transactions between related companies. In any event, countries should not accept a unilateral APA with a taxpayer who should expect the payer to waive access to the mutual agreement procedure in the event of a transfer pricing dispute. When another country increases the adjustment of transfer prices to a transaction or expenditure under the unilateral APA, the first country is encouraged to consider the appropriate adjustment and not to regard the unilateral APA as an irreversible regime. The OECD guidelines provide that most countries prefer bilateral or multilateral APA for double taxation, and some countries will not grant unilateral APA to taxpayers in their area of jurisdiction. The bilateral approach is much more likely to ensure that the rules reduce the risk of double taxation, that they are fair to all jurisdictions and taxpayers who are subject to it, and that the taxpayers concerned enjoy greater security.

United States – In March 1991, the Internal Revenue Service issued the revenue procedure that approved the APP contracts. A policyholder has the flexibility to request a pre-notification conference. Detailed documentation requirements are required. As part of the contract, the payer undertakes to submit to the APA management reports demonstrating compliance with the company`s rules, with particular emphasis on the acceptable application of the chosen transfer pricing method. The payer is responsible for accepting the initial amount he requires from his APA; the particular beginning is left to the discretion of the subject. The conclusion may be a statement of intent between governments and the payer. Once it is consensual, the payer has mixed the instrument, the APA, and the last act is also the execution of that instrument. The Internal Revenue Service may revoke an APA in case of fraud or actus reus. In addition, the introduction of measures such as Early Pricing Agreements (ASAs) and Safe Harbour benchmarks have certainly helped us to bring our transfer pricing rules in line with OECD policies and alternative international best practices, including aggressive reductions in sanctions. It would go a long way to improve India`s name as an attractive target for foreign direct investment, a goal that successive governments want to achieve.

Given that the purpose of an APA is to ensure the safety of all taxpayers and tax authorities, an APP system is a welcome change that will bring greater security to the transfer pricing regime in India, which has recently seen an increasing number of disputes and disputes.
